N J man died after inmate stabbed him because he didn t get proper medical care suit alleges Ashton Barthelus 26 has been charged with murder in the death of Dan Gelin 27 after an inmate stabbed him repeatedly at the Essex County Correctional Facility in December, his family’s attorney said.The following day, authorities found him unresponsive, breathless and pulseless in a jail cell surrounded by blood-stained towels. An hour later, he was pronounced dead. The circumstances surrounding his death are now the subject of a civil rights lawsuit filed last week in state Superior Court, charging that the jail and its officers failed to protect the 27-year-old from aviolent inmatewho allegedly attacked him multiple times before his death. According to the lawsuit, from January to December 2021, Gelin had at least five altercations at the jail, including two that sent him to the emergency room. The lawsuit alleges that “some, if not all,” involved Barthelus. On Dec. 2, the suit alleges Barthelus brandished a long silver object and stabbed Gelin “repeatedly” while yelling, “Why you been disrespecting me?” The lawsuit says a medical professional with CFG Health Systems, the jail’s healthcare provider, treated Gelin and that a nurse provided “wound care” before clearing him to return to the general population. Officials did not transport Gelin to the hospital, and he did not receive an ultrasound or CT scan to check for internal injuries, the lawsuit said. At 7:56 a.m. the next day, Gelin was found unresponsive in his cell on a stool covered in towels drenched in blood, according to the lawsuit. The lawsuit said he was transported to University Hospital, where doctors noted a left thoracoabdominal stab wound and cardiac arrest. Gelin was pronounced dead at 9:03 a.m. Barthelus has been .
